TERMS AND CONDITIONS OF VELO PLUS

SCOPE OF APPLICATION

These Terms and Conditions VELO+ (hereinafter "Terms and Conditions") apply to the reward program VELO+ (hereinafter "VELO+") implemented on the website www.velo.com/ch (hereinafter "Website"). The Website is operated by British American Tobacco Switzerland SA, Route de France 17, 2926 Boncourt (hereinafter "BAT" or "we" or "us").

We reserve the right to amend and modify these Terms and Conditions at any time. The Terms and Conditions that are in force at the moment of your access to and when you interact with VELO+ are applicable. It is your responsibility to check the General Terms and Conditions regularly.

BAT reserves the right to change the rules and functionality of VELO+ at any time. 

In the event of any differences between the German, French and English versions of the Terms and Conditions, the English version will take precedence.

GENERAL CONDITIONS OF PARTICIPATION

Participation is reserved exclusively for to tobacco and/ or nicotine consumers over 18 years and who are residents in Switzerland and who have registered on www.velo.com/ch. The indicated delivery address must be in Switzerland. Employees of BAT, and of all subsidiaries of the BAT Group in Switzerland and worldwide, as well as their family members, are excluded from participation in VELO+.

RULES OF PARTICIPATION

• Participants who have set up a user account on www.velo.com/ch and have met the requirements for eligibility (particularly regarding age verification) may participate in VELO+ after reading and accepting these Terms and Conditions.
• Points are credited to the corresponding user account after the user successfully completes any actions mentioned below in Number 6. Further information about how to acquire points can be found on the Website. Points are included in the price of the can. By purchasing products on the Website, the user buys points to redeem in the VELO+. The value of the points are included in the price and corresponds to 5% of the value (1 CHF = 5 points). The points can be exchanged for online discounts and/or for VELO merchandise products, as long as the users have the corresponding amount of points on their account and the selected item(s) is/are still available/in stock. Whenever points are exchanged for online discounts at checkout and/or for VELO merchandise products, the user will not receive any points for this purchase. VELO+ points can be used in combination with a voucher/code at checkout.
• The quantity and selection of available VELO merchandise products is limited and may change from time to time. VELO Merchandise products are exclusively acquirable with VELO+ points.
• After redeeming their points, the user will see a confirmation on their screen and receive another confirmation sent to the e-mail address they used to register on www.velo.com/ch; points corresponding to the value of the VELO merchandise products are then deducted from the user’s account.
• The redeemed merchandise will be sent to the user at the address specified in the user account. This address may not be modified after the order is placed.
• VELO+ points earning system:

For the actions listed below, the user will receive corresponding points. Activities that are not listed will not be rewarded and will not provide the user with points on VELO+.

• BAT reserves the right to change, in particular, add new activities with whom the user can acquire points or to exclude any activity at any time. Relevant are the activities mentioned on the Website at the time of your interaction with VELO+.
• VELO+ points use:

a. VELO+ points can be used for online discounts on VELO e-shop or on VELO merchandise products.

b. The current spending rate on our e-shop is 100 points = 1CHF. VELO+ points can be used to pay for maximum of 50% of the total amount of your order of Products on the e-shop.

c. VELO Merchandise products can only be acquired with VELO+ points.

• Points cannot be exchanged, transferred to another user, or paid out in cash. BAT reserves the right to terminate VELO+ at any time, in which case BAT will notify participants by e-mail within a reasonable time so that they can redeem their final points before the end of the program. All decisions are final. No argumentation, revisions or correspondence will be entertained in this regard. 
• If a user de-registers or cancels the user account on the Website, all rights to accumulated points will expire.

TERMS OF USE AND DATA PRIVACY

The access to the Website and the usage of the Website is governed by the Terms of Use. These provisions are incorporated into this Terms and Conditions by reference.

Information about the processing of your personal data in connection with VELO+ can be found in the Data Privacy Policy.

WARRANTY AND LIABILITY

Warranty and liability as well as delivery for the VELO merchandise products redeemed with points are governed by the Terms and Conditions of Sale. These provisions are incorporated into this Terms and Conditions by reference.

If points are redeemed in the form of discounts for future purchases on the Website, the provisions in the Terms and Conditions of Sale are applicable.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with Swiss law, the application of the United Nations Convention on Contracts for the International Sale of Goods being expressly excluded. The place of jurisdiction is the user's place of residence, which must be in Switzerland.

MODIFICATIONS AND UPDATES

BAT reserves the right to change, modify, or alter the terms of these Terms and Conditions. If you continue to use the VELO+ program on this Website after any amendments to our most up-to-date version of these Terms and Conditions, it signifies your acceptance of the revised terms.
