The services available at www.velo.com/en-id is a website-based program (the “Services”) containing, including but not limited to, information, programs, advertisements, promotions, and other communications relating to tobacco products, electronic cigarettes, and/or other products. This Services are intended for adult tobacco or nicotine product users aged 21 (twenty-one) years or older, who are not pregnant women, are Indonesian citizens and domiciled in Indonesia, and are legally competent to enter into a valid and binding agreement. This Services owned by PT Bentoel Distribusi Utama (“Bentoel”), which operates in the trade of tobacco products and electronic cigarettes. All content displayed on this Services are protected by applicable laws and regulations, including but not limited to provisions relating to copyright, trademarks, patents, trade secrets, and other relevant regulations.
Bentoel, and where applicable, other operators and service providers supporting the operation and management of the Services, have entered into separate cooperation agreements in accordance with applicable laws and regulations.
These Terms and Conditions (“Terms”) constitute an agreement governed by the laws of Indonesia and contain important information regarding your rights and obligations in connection with your access to and use of the Services.
We may amend, add to, or remove provisions from these Terms, including by introducing new features to the Services, from time to time based on reasonable basis. Any such changes shall constitute an integral and inseparable part of these Terms. We encourage you to review these Terms periodically through the Services in order to remain informed of the latest applicable changes. If we make any updates or changes to these Terms, we will obtain your consent in accordance with the applicable provisions.
You may be able to access and use this Services from jurisdictions outside the Republic of Indonesia. If any material contained in this Services is contrary to the laws and regulations applicable in the jurisdiction from which you access and use this Services, then this Services are not intended for you, and we request that you immediately cease accessing and using this Services.

USE OF WEBSITE

You are only permitted to access the Services, provide consent, provide or complete personal data, or approve the completion of your personal data on this Services if you are an adult tobacco or nicotine product user who is 21 (twenty-one) years or older, not a pregnant woman, an Indonesian citizen and domiciled in Indonesia, and legally competent to enter into a valid and binding agreement (“User”).
By accessing this Services, the User is deemed to have read, understood, agreed, and consented to comply with and be bound by these Terms. You may also read these Terms in their entirety through the Services.
This Services are owned and operated by PT Bentoel Distribusi Utama (“Bentoel”). Therefore, in these Terms, the terms “we” and “by us” refer to Bentoel, and the term “you” refers to the User.
If you do not agree to these Terms or any updates made to these Terms from time to time, you are not permitted to access or use this Services and must immediately cease all access to and use of this Services. If we require you to provide consent to any updates to these Terms that we may make in the future, you may not be able to continue using the Services until you provide the requested consent.

ABOUT ACCESSING AND USING OUR SERVICES

This Services are intended solely for adult tobacco or nicotine product users who are 21 (twenty-one) years or older, not pregnant women, Indonesian citizens, and domiciled in Indonesia, legally competent to enter into a valid and binding agreement, and in possession of a valid Identity Card (Kartu Tanda Penduduk or KTP) issued by the Government of the Republic of Indonesia.
We and, where applicable, other operators shall not be responsible for any errors or inaccuracies in the information provided by prospective Users in the process of providing consent, completing personal data, or providing consent for the completion of personal data.
You agree that the information and personal data that you provide through this Services will be processed, including stored and used by Bentoel, its affiliates, and parties cooperating with Bentoel for purposes that do not contravene the provisions of the applicable laws and regulations.
You agree that your information and personal data may be transferred and/or stored outside the jurisdiction of the Republic of Indonesia in accordance with the provisions of the applicable laws and regulations.
You are responsible for maintaining the confidentiality of, where applicable, your account name, password, and the security of your account.
You have the right to choose not to continue with anything related to this Services, including choosing to no longer receive notifications and communications, and to request the deletion of your information and personal data that you have provided through this Services.
Any action taken by you that, in our judgment, may disrupt the operation of the Services in any manner or form shall entitle us to take any necessary action, including pursuing legal remedies against you in connection with such action.
We are not responsible for the internet connection and mobile service charges that you may incur in order to access and use this Services. We recommend that you contact your mobile operator or internet service provider first if you are uncertain about the charges that may be imposed before you access and use this Services.
In certain circumstances, this Services or part of the Services may be unavailable due to technical reasons or maintenance activities, whether scheduled or unscheduled.

USER CONDUCT AND CONTENT

You warrant that all information and data that you provide through this Services are at all times true, accurate, current, and complete. You agree to update your information and personal data if required to maintain the truthfulness and accuracy of your personal data.
Information, data, software, audio, photographs, graphics, videos, tags, or other materials made available through this Services may be sent, uploaded, communicated, or transmitted by you or other users. You understand and agree that all materials that you upload while using this Services, whether publicly uploaded or privately transmitted, are entirely your personal responsibility. You are prohibited from accessing the Services by any means not stipulated in these Terms, which may result in you being deemed to have accessed the Services unlawfully or in violation of applicable laws and regulations.
You are solely responsible for all activities associated with your account, and you agree not to sell, transfer, or grant any license over your account to any party.
You agree not to create any account other than for yourself or to maintain more than one account for yourself.
You agree not to use the login credentials of another User on the Services.
You agree not to upload, communicate, send, transmit, or otherwise make available any material whatsoever, including but not limited to:

material that is unlawful or that may be considered to be used for unlawful purposes or other illegal, harmful, harassing, defamatory, libellous, obscene, or inappropriate purposes;
material that constitutes or may be considered a violation of another person's privacy;
material that may or could reasonably be considered as incitement to violence or hatred against any race or ethnic group;
material that you are not legally entitled to provide or distribute, including but not limited to another person's personal information, another party's proprietary information, or confidential information;
material that infringes intellectual property rights or other proprietary rights;
material consisting of unlawful or unsolicited advertisements, promotional materials, unsolicited junk mail, spam, chain letters, pyramid schemes, or other similar forms; or
material containing software viruses or other computer code, files, or programs designed to interfere with, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.

You agree that you will not:

use this Services to harm or harass other persons or engage in conduct that causes a violation of law;
use or imitate another person's information and personal data, falsify your identity, create a false identity, or create an identity that appears to be affiliated with a particular party for the purpose of using this Services;
disguise, anonymize, or conceal your IP address or the source of any material that you may upload to this Services;
use this Services for commercial or business purposes, for the benefit of any third party, or to send unsolicited communications;
remove or alter information containing intellectual property rights from the Services or any part of this Services;
interfere with or disrupt this Services or the servers or networks that provide this Services;

LIMITATION OF LIABILITY AND INDEMNIFICATION

All risks arising from your use of this Services shall be entirely your responsibility. Any damage to the computer or other devices that you use, as well as any loss of data arising from the use of this Services, shall be entirely your responsibility.
You agree to release and hold harmless us and our affiliates from and against any and all demands, claims, losses, and costs, whether direct or indirect, that may arise in connection with your use of the Services.

INTELLECTUAL PROPERTY

You acknowledge and agree that all copyrights, trademarks, and other intellectual property rights associated with this Services are owned by us or by third parties who have granted licenses to us.

MARKETING AND PROMOTION

Bentoel may use your information and personal data to send materials, notices, information, advertisements, promotions, and other communications relating to tobacco products, electronic cigarettes, and/or other products through various means of communication to you, including but not limited to email, telephone, short message service (SMS), or other means of communication, whether sent directly by Bentoel or by third parties appointed by or cooperating with Bentoel from time to time.

CUSTOMER SERVICE

Bentoel may use your information and personal data, including the data that you directly provide to Bentoel in various communications, to provide you with support through Bentoel's customer service channels whenever you require it. Bentoel, its affiliates, and parties cooperating with Bentoel may also use such information and personal data to contact you, for example as part of customer service activities or to send you updates regarding our products and programs. Bentoel will also use your information and personal data to maintain a good relationship with you.

ANALYSIS AND RESEARCH

Bentoel may use your information and personal data to conduct research, surveys, or interact directly with you, for example by sending various communications to you through email, telephone, text messages or Short Message Service (SMS), or other means of communication. Bentoel, its affiliates, and parties cooperating with Bentoel may also use such information and personal data to prepare reports and conduct analyses for research purposes or business needs.

SOCIAL AND COMMUNITIES

We have various social and community channels that we use to communicate with Users. If you choose to interact through such channels, we will receive your information and personal data, and use it in connection with your use of such channels, including to communicate with you. We may also repost your submissions to such channels.

CONFIRMATION

Subject to the provisions of the applicable laws and regulations, by agreeing to these Terms, you acknowledge and authorize Bentoel, its affiliates, and parties cooperating with Bentoel to use your information and personal data for the purposes as described in these Terms and the Privacy Policy.

FRAUD, CRIME, AND DECEPTION PREVENTION

Bentoel may use your information and personal data stored by Bentoel for the purposes of fraud, crime, and deception prevention. Bentoel may also disclose your information and personal data to the competent authorities for the purposes of fraud, crime, and/or deception prevention, including but not limited to the Indonesian National Police and other authorities authorized in accordance with the provisions of the applicable laws and regulations.

LAW ENFORCEMENT

We may use your information and personal data where required and permitted by the provisions of the applicable laws and regulations.
